QuantLink's process for handling copyright infringement claims under the DMCA.



1. Overview

QuantLink AI ("QuantLink," "we," "us," or "our") respects the intellectual property rights of others and expects users of the Service to do the same. This DMCA & Copyright Policy describes how QuantLink addresses allegations of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512.


2. Respect for Intellectual Property

QuantLink is committed to complying with U.S. copyright law and responding to claims of copyright infringement. We will respond expeditiously to notices of alleged infringement that comply with the DMCA and other applicable intellectual property laws.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Service, please follow the notification procedure described below.


3. DMCA Takedown Procedure

If you are a copyright owner (or authorized to act on behalf of a copyright owner) and believe that content on the Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Upon receipt of a valid DMCA notice, QuantLink will:

  1. Review the notice for compliance with the DMCA requirements described in Section 4
  2. Remove or disable access to the allegedly infringing material expeditiously
  3. Notify the user who posted the material that it has been removed or disabled
  4. Provide the user with information about how to submit a counter-notification if they believe the material was removed in error

4. DMCA Notification Requirements

A valid DMCA takedown notice must be a written communication that includes the following:

  1. Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notification, a representative list of such works)
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit QuantLink to locate the material (e.g., the URL or specific page)
  3. Your contact information, including your name, address, telephone number, and email address
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed
  6. Your physical or electronic signature (or the signature of the person authorized to act on behalf of the copyright owner)

Note

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.


5. Counter-Notification

If you believe that material you posted on the Service was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated agent. A valid counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are located outside the United States, the District of Delaware), and that you will accept service of process from the person who provided the original notification or an agent of such person

Upon receipt of a valid counter-notification, QuantLink will promptly provide the original complainant with a copy of the counter-notification and inform them that the removed material may be restored in ten (10) to fourteen (14) business days. Unless the copyright owner files an action seeking a court order against the user, the removed material may be restored after ten (10) business days.


6. Repeat Infringers

In accordance with the DMCA and other applicable law, QuantLink has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. QuantLink may also, at its sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Please note that DMCA notifications sent to other email addresses or through other channels may not be processed in a timely manner.


8. Good Faith Requirement

We remind all parties that the DMCA requires good faith in all notifications and counter-notifications. Pursuant to 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing — or that material or activity was removed or disabled by mistake or misidentification — may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, the copyright owner, or the copyright owner's authorized licensee.

Before submitting a DMCA notification, please consider whether the use of the material may constitute fair use under 17 U.S.C. § 107.
